Applying for an extension of a residence permit to work as a civil servant for a German employer
Service description
If you are employed as a civil servant by a German employer and are staying in Germany to carry out your official duties, you will generally hold a temporary residence permit. You can apply to extend your residence permit if it is due to expire and you wish to continue your service within Germany.
You should apply to the immigration authority responsible for your place of residence to extend your residence permit no later than eight weeks before it expires.
The same conditions apply to the extension as to the initial grant. This means that you must still be employed as a civil servant by a German employer and wish to remain in Germany in order to fulfil your official duties.
In the event of an extension, your residence permit will once again be granted for a fixed period. The duration of this period will depend on the planned duration of your employment.
The Federal Employment Agency does not need to be involved in the renewal of your residence permit.
You may have been required to attend an integration course when your residence permit was first granted. If this is the case, it must be taken into account when renewing your residence permit. If you have not yet attended an integration course, the Foreigners’ Registration Office may reject your application to renew your residence permit. If you have not yet completed the integration course, your residence permit will generally only be extended for one year at a time until you have successfully completed the course or provided evidence that you have otherwise integrated into social and community life.
If you have held a residence permit for the purpose of performing duties for a German employer for three years, you are entitled to be granted a permanent residence permit (Niederlassungserlaubnis). In this case, the requirement to have paid contributions to the statutory pension insurance scheme for at least 60 months or to provide evidence of expenditure entitling you to comparable benefits does not apply.
