Service description
Building easements are obligations under public law imposed on landowners to perform, tolerate or refrain from certain acts in relation to their land, which do not already arise from provisions of public law. This enables the extension of building or use on another plot of land.
Building encumbrances are assumed by means of a written declaration to the building control authority. The register of building encumbrances is maintained by the building control authority. Other obligations under building law incumbent on the landowner in relation to any action, tolerance or omission concerning his or her property, as well as any conditions, terms, time limits and reservations of revocation, may also be entered in the register of building encumbrances.
Information from the register of building encumbrances provides clarity regarding public-law obligations attached to a plot of land. This is essential for the planning and implementation of building projects. Anyone who can demonstrate a legitimate interest may inspect the register of building encumbrances or obtain copies of it.

Prerequisites
As a general rule, you must demonstrate a legitimate interest in order to be allowed to inspect the register of building encumbrances. For example, owners, their authorised representatives and prospective buyers of a plot of land have a legitimate interest.
The following are not required to demonstrate a legitimate interest: notaries, and solicitors who wish to inspect the register of building encumbrances on the proven instructions of a notary, as well as publicly appointed surveyors.

What fees are incurred?
The registration and cancellation of a building easement, as well as other entries in the register of building easements, are subject to a fee, as are copies of the register. The amount of the fee is determined in accordance with the Building Fees Regulation (BauGVO).
