Apply for authorisation to supply or make available certain hazardous substances and mixtures

If you wish to supply substances or mixtures that must be labelled in accordance with the CLP Regulation (Regulation EC No. 1272/2008) on a commercial basis or independently as part of a commercial enterprise with
- the hazard pictogram GHS06 (skull with crossed bones)
or
- the hazard pictogram GHS08 (health hazard)
and
- the signal word Danger, and one of the hazard statements
- H340 - May cause genetic defects.
- H350 - May cause cancer.
- H350i - May cause cancer by inhalation.
- H360 - May damage fertility or the unborn child.
- H360F - May damage fertility.
- H360D - May cause harm to the unborn child.
- H360FD - May damage fertility. May damage the unborn child.
- H360Fd - May damage fertility. Suspected of damaging the unborn child.
- H360Df - May damage the unborn child. Suspected of damaging fertility.
- H370 - Causes damage to organs (by inhalation/skin contact/swallowing).
- H372 - Causes damage to organs through prolonged or repeated exposure (prolonged or repeated inhalation/skin contact/swallowing).

Before you intend to supply or make products available in the retail trade, you must check whether you need to apply for a licence.
The delivery or provision of the labelled substances and mixtures is only possible by a person employed in the company who
- has provided proof of expertise,
- has the necessary reliability and
- is at least 18 years old.
If your company has several business premises in which the labelled substances and mixtures are to be supplied, you must employ at least one person in each business premises who fulfils these requirements.
The authorisation may be restricted to individual hazardous substances or mixtures or to certain groups of substances or mixtures. It may be subject to certain conditions that must be complied with. Conditions may also be imposed retrospectively.
You do not need a licence
- as a manufacturer, importer and distributor if you supply the aforementioned substances and mixtures exclusively to resellers, professional users or public research, testing or teaching institutions. In these cases, however, you are obliged to notify the intended activity.
- Pharmacies are also exempt from the authorisation requirement.

What else should I know?
Proof of expertise is a prerequisite for the granting of a licence. Expertise can be demonstrated by passing an examination or acquiring another qualification. The following other qualifications are considered proof of expertise:
- chemists (under certain conditions),
- Pharmacist,
- Pharmaceutical engineers,
- Pharmaceutical-technical assistants,
- Pharmacy assistants,
- certified pest controllers or
- Persons who have completed vocational training as pest controllers.
