Applying for an extension of a residence permit for qualified persons granted temporary leave to remain for the purpose of employment
Service description
You may apply to extend your residence permit, issued for the purpose of employment, as a qualified person with temporary leave to remain, if you wish to continue in employment and continue to meet the other requirements. In principle, the same conditions must be met for the extension of the residence permit as for its initial issue. In particular, you must be able to support yourself and cover your health insurance costs from your own resources without having to rely on public benefits.
In order to process your application, the Foreigners’ Registration Office usually involves the Federal Employment Agency, which checks the working conditions. After holding a residence permit for two years, and provided that you have been in employment commensurate with your professional qualifications during that time, there are no longer any restrictions on your access to the labour market.
In the event of an extension, your residence permit will once again be granted for a fixed period. As a rule, the residence permit cannot be extended if this was already ruled out when the permit was first granted or during the most recent extension.
Procedure
- Find out whether your foreigners authority allows you to apply online or has a special application form.
- If the application can only be submitted in person, make an appointment at the Foreigners' Registration Office. If you apply online, the Foreigners' Registration Office will contact you after receiving your application to arrange an appointment.
- During the appointment, your identity and documents will be checked (please bring your documents to the appointment, preferably in the original).
- If your application is approved, your fingerprints will be taken for the production of a new electronic residence permit (eAT card). The Foreigners’ Registration Office commissions the Bundesdruckerei to produce the eAT card. Once it is ready, you will be notified and can collect your residence permit from the relevant office. As a general rule, you must collect the eAT card in person.
- If your application is rejected, you will receive a rejection notice.
Who should I contact?
The immigration authority responsible for the applicant’s place of residence is responsible for processing the application.
